TERMS AND CONDITIONS

 

Please read these Terms and Conditions carefully before ordering any Products from the Platform. By using our Platform, you indicate that you accept these Terms and Conditions and that you agree to abide by them. 

 

Parties Involved

This contract is between

  1. Nukilan Biruni Trading, a Malaysia-based business with company registration number 201903040706 (PG0467886-D)  (“Seller”) and

  2. Member of Nukilan Biruni Trading identified by his/her email address (“Buyer”)

Collectively known as “Parties” to this contract

“Site” refers to Seller’s website located at https://www.nukilanbiruni.com

 

Business Hour

Our business days are Mondays to Fridays, excluding Saturdays, Sundays & Public Holidays.

 

Miracle Planner Pre Order Policy

The Miracle Planner is expected to be fulfilled from the period of late December to early January. No cancellation or refund can be made by Buyer within the Pre Order period. Buyer can only claim for a refund if the planner is not shipped out after 31st of January 2021 onwards.

 

STARGAZER PDF Copyright Policy

No parts of the STARGAZER PDF may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or any other electronic or mechanical methods, without the prior written permission of the publisher Nukilan Biruni Trading, except in the case of brief quotations embodied in reviews and certain other non-commercial uses permitted by copyright law.

 

Peak Period Notice

During peak period, Seller will take a longer fulfillment time of 5 to 7 working days instead of the usual 2 to 3 working days.

 

Order Acceptance Policy

The receipt of an e-mail order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Seller reserves the right, without prior notification, to limit the order quantity on any item and/or refuse service to any Buyer. 

 

Return/Refund Policy

All items are non-refundable once Buyer has completed the payment of the order. Exchanging or adding products to an existing order are strictly not allowed. Buyer may log in and purchase a new order from the website instead. Voucher codes cannot be re-issued and are non-refundable.

 

Buyer is only eligible to claim for a refund in the following circumstances;

  1. Technical issue with the payment process on Site whereby proven that the payment has been deducted from Buyer's account and order affected is wrongly cancelled by system.

  2. Buyer failed to receive the item more than 20 working days for domestic order and 50 working days for international order from the date of purchase. Buyer is given the option for a full refund only after Seller has conducted an investigation with the courier and parcel is declared as lost parcel. The claim must not be made any later than 60 working days from date of purchase. This is not applicable to pre order items which has been made clear of the order duration prior on Site. 

  3. Buyer received faulty/damaged item provided with strong evidence. Shipping fee is excluded from the total refund amount. Buyer is obliged to return the faulty/damaged item to Seller’s address. The claim will be fully investigated prior to approval of refund. Please attach the picture of the faulty/damaged item in the form link attached. (Buyer is only eligible to claim for a refund within 5 working days from the date of item being received. Buyer must choose between refund or redelivery, opting for both options are not allowed.)

Note: Buyer’s refund request will be processed within 14 working days. Once we have processed Buyer’s claim, we will notify Buyer of the outcome via email. In the event Buyer still has not received any update, Buyer may contact us at [email protected]


 

Redelivery/Exchange Policy

Buyer is only eligible to claim for redelivery/exchange within 5 working days from the date of received item in the following circumstances;

  1. Buyer received faulty/damaged or missing item provided with strong evidence. As for the missing item, we will only redeliver the missing item only and not the whole order. If the faulty item is due to printing error only, Buyer is obliged to return the faulty item to Seller’s address and provide proof of return. 

  2. Buyer received wrong item. Buyer is obliged to return any wrong item to Seller’s address. Buyer must keep the shipping fee receipt for the return of the wrong item to claim for the shipping fee later. Buyer must also provide shipment slip as proof of return of the wrong item.

  3. In the event of returned delivery which is due to parcel being unclaimed by Buyer. New redelivery charges will be borne solely by Buyer.

 

Seller will conduct an investigation prior to processing all claims for redelivery/exchange. If the claim is approved, Seller will arrange for redelivery/exchange of the item. For missing or incorrect add-on are not eligible for redelivery/exchange but Buyer may request for partial refund of the add-on. Add-on example: Vintage Book Wrap service.  Note: Buyer’s redelivery/exchange request will be processed within 14 working days. Once we have processed Buyer’s claim, we will notify Buyer of the outcome via email. In the event Buyer still has not received any update, Buyer may contact us at [email protected]

Cancellation Policy

 

Cancellation of order by Buyer is NOT ALLOWED once payment has been completed. As for any unpaid order, Seller’s system will auto cancel Buyer’s order within 24 hours. There are circumstances when Seller might also have to cancel a particular order.  Buyer’s receipt of order confirmation does not signify Seller’s final acceptance of Buyer’s order and Seller reserves the right at any time after the receipt of the order to accept or decline Buyer’s order for any reason.

 

Although Seller’s online stock inventory is programmed to update automatically, Seller reserves the right at any time after receipt of Buyer’s order, to inform Buyer via email or text about a shortfall in the quantity ordered of any item. In all such cases, Seller has the right to either supply Buyer less than the quantity ordered or cancel the order with prior notice to Buyer.

 

Indemnification 

Buyer agrees to defend, indemnify and hold Seller harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from Buyer's use of the Site including purchase of products.

 

Disputes 

With respect to any dispute regarding the Site, all rights and obligations and all actions contemplated by these Terms of Sale shall be governed by the laws of Malaysia as if the Terms and Sale were a contract wholly entered into and wholly performed within Malaysia.

 

General 

Seller reserves the right, in our sole discretion, to change these Terms of Sale at any time by posting the changes on the Site. Any changes are effective immediately upon posting to the Site.
